Book-pricing saga enters closing chapter

first_imgThe institution is preparing to outlaw two price-fixing pacts between publishers and retailers, six months after issuing a statement of objections to the deals arguing that they breached EU competition rules.The parties to the book pacts submitted a 400-page reply to Competition Commissioner Karel van Miert, claiming that abolition of the price-fixing deals would lead to the destruction of large parts of the market for German language literary works, and put small booksellers at the mercy of bigger competitors able to slash prices.The industry maintains that the diversity of titles available in bookshops shrinks when pricing agreements are abandoned, pointing to developments in the UK and US since they ended the system to support its claims. It will get another chance to argue its case at a special hearing later this month with Commission and member state competition experts. But a spokesman for Van Miert said the institution had not changed its mind, adding that it would be ready to give a final ruling onthe price pacts “soon after” the hearings. Other sources, however, suggested that the parties could play for extra time by changing the substance of their agreements, forcing the Commission to rewrite its original statement of objections issued in January.“The hearings will give the chance for an exchange of views, but the Commission’s views are pretty much unchanged,” said the spokesman. “The statement of objections we put out is our full opinion. It is clear that to avoid a negative decision they would have to change the schemes, although this does not rule out there being schemes that could be approved.”However, industry groups, including the German Writers’ Association, have already attacked Van Miert’s proposal for a writers’ support fund to combat any threat to the future of German language literary works.Association chairman Fred Breinersdorfer pointed out that such a scheme would require the creation of a censoring body to decide which books would receive funding.The Commission began its probe into the pricing pacts between Germany and Austria six years ago following a string of complaints from libraries in both countries, as well as Libro, a 200-strong chain of Austrian shops.Van Miert has always argued that the UK and US markets have flourished since similar price-fixing deals were ended.
